GENERAL CONDITIONS OF SALE MAISON PIC - VALENCE
PREAMBLE
These general conditions of sale (the “CGV”) apply to any reservation made at MAISON PIC located at 285, Avenue Victor Hugo in Valence (26000) by a Customer (as defined below) by any means defined below, including via the website accessible at https://anne-sophie-pic.com (the “Site”).
THIS HAVING BEEN STATED, THE FOLLOWING WAS AGREED:
ARTICLE 1 — DEFINITIONS
The terms used in the body of the GTC, including its preamble, and beginning with a capital letter, whether used in the singular or the plural, will have the meaning given to them below.
Customer : refers to the natural person of full age, having full legal capacity allowing him to engage under the CGV, and acting for his own needs, excluding any activity of intermediation, resale, distribution or similar of all or part of the Services.
contract : refers to the Terms and Conditions as well as the Special Conditions or the Cancellation Policy, as the case may be, as summarized in the Confirmation Email.
Special conditions : refers to the special conditions of reservation, cancellation, no show, no show, minimum number of people, guarantee... communicated by PIC when booking and which are summarized in the Confirmation Email.
Confirmation email : refers to the confirmation email sent by PIC to the Customer to the email address provided by the Customer at the time of booking and/or purchase, containing a summary of the Contract and specifying in particular the conditions of the reservation (Reserved Services, Special Conditions, prices and possible taxes, prices and possible taxes, prices of Ancillary Services, prices of Additional Services, prices of Services Accessories, prices, etc.), hours of arrival/departure (check-in/check-out), rules applicable to the stay in PIC, dates of reservation, guarantee) and/or the details of the order made.
Parties : refers collectively to PIC and the Customer.
PIC or Pic House : refers to the company PIC — SAS registered with the RCS of Romans under the number 436 280 572-285, whose head office is located Avenue Victor Hugo 26000 Valence — operating the establishment La Maison Pic.
Cancellation Policy : refers to the special conditions applicable to the modification and/or cancellation of a Service, Catering or Accommodation.
Confidentiality Policy : refers to the personal data protection policy.
Department (s) : refers to the Accommodation Services, Catering Services and other Ancillary Services offered to Customers by Maison PIC on the Site, such as concierge services.
Accessories Services : refers to the additional products and/or services offered to the Customer during the Version of 11/02/2026 when booking an Accommodation Service (such as, for example, a bottle of champagne, bouquet of flowers, etc.).
Lodging service : refers to the accommodation service (stay) within the PIC Hotel, for the duration and on the dates selected by the Customer and under the conditions provided for herein and/or on the Site.
Catering service : refers to the catering service offered within the Maison PIC, namely the Pic 3* Restaurant, Bistrot André, Le Bar, le 4h.
ARTICLE 2 - PURPOSE
The Contract regulates the contractual relationships between the Customer and PIC with whom the Customer makes a reservation and/or a purchase. The Terms and Conditions are made available to the Customer on the Site where they can be consulted at any time. The Customer has the option of keeping and/or editing the GTC using the standard functionalities of his browser and/or computer. The GTC are also communicated by PIC to the Customer, when booking or buying, as well as on request.
The T&Cs prevail over any other document with respect to their subject, except on the Special Conditions or on the Cancellation Policy which prevail over the T&Cs in the event of a conflict.
The Contract expresses all the obligations of the Parties. No general or specific conditions communicated by the Customer may be incorporated into or added to the Contract, except with the express prior agreement of PIC.
Prior to any reservation of a Service, the Customer is duly informed of the GTC and declares (i) that he is acting for personal purposes that do not fall within the framework of his commercial, industrial, artisanal, liberal or agricultural activity and (ii) have full legal capacity allowing him to engage under these GTC. Any reservation implies full and unreserved acceptance by the Customer of these Terms and Conditions of Sale.
ARTICLE 3 — RESERVATION
3.1. Booking process and acceptance of the Contract

- directly at the Maison PIC reception,
- via a duly authorized third party (e.g. travel agent, company, association, etc.).
Any reservation implies the reception, consultation and complete and unreserved acceptance of the Terms and Conditions by the Customer.
In the event of a reservation on the Site, PIC invites the Customer to carefully read the Terms and Conditions and the Special Conditions of the Reserved Rate and/or the Cancellation Policy, as the case may be, and to check the corresponding box prior to each reservation and/or purchase. The Terms and Conditions as well as the Special Conditions and the Cancellation Policy will be sent to the Customer by email to the email address provided by the latter.
The Customer acknowledges having read the nature, destination and terms of reservation of the Services and having requested and obtained the necessary and/or additional information to make a reservation and/or purchase in full knowledge of the facts. Additional checks can be carried out directly with PIC, if necessary, via the “Contact” tab available on the Site.
It is expressly agreed between the Parties that any reservation of a Service is nominative and may under no circumstances be transferred in whole or in part, to a third party, whether free of charge or for a fee or on a commercial basis.
When booking, the Customer is informed of the maximum occupancy capacity of the room category or suite booked and may under no circumstances exceed this capacity. If necessary, the Customer must reserve an additional room.
In the case of reservations for Groups or as a Seminar, an estimate will be sent to the Customer for prior acceptance.
3.2. Confirmation of reservation and/or purchase
Once the Customer has made a reservation for a Service under the conditions of article 3.1, the Customer receives a Confirmation Email at the email address he provided.
In the event of a reservation of a Service, the reservation will only be considered as definitively made after payment of the reservation by the Customer under the conditions provided for in article 6 of the CGV, except in the case of a reservation guarantee as provided in article 6.2.1 (i): in the latter case, the reservation is considered to be definitively made upon receipt, by the Customer, of the Confirmation Email.
3.3 Absence of right of withdrawal
It is recalled that, in accordance with article L. 221-28 12° of the Consumer Code, the Customer does not have a right of withdrawal provided for in article L. 221-18 of the Consumer Code for Services.
3.4. Cancellation or modification by the Customer
The booked Services are exclusively subject to the cancellation and/or modification conditions provided for in the Special Conditions and the Cancellation Policy for the Services, and are summarized in the Confirmation Email. Depending on the Special Conditions or the Cancellation Policy, PIC may charge cancellation fees and, where applicable, all or part of the price of the booked Services, which will be deducted from the amounts paid in advance if applicable or which will be deducted from the amount retained as a guarantee (if the reservation was not paid in advance) and which, in addition, will be invoiced to the Customer. PIC also reserves the right to put the Service concerned back on sale. It is recalled that the deposit paid by the Customer will not be subject to any refund beyond the deadline of the Cancellation Policy and/or modification of the reservation.
3.5. Cancellation due to PIC
In the event that PIC cancels the Contract, the Customer is entitled to receive compensation equal to (i) the amount of the deposit paid by the Customer or (ii) twice the deposit paid by the Customer.
3.6. Interruption of stay
In the event of interruption of the stay by the Customer for any reason whatsoever, the entire stay as recalled in the Confirmation Email will be due; no refund of any kind whatsoever can be granted as a result.
3.8. No-show and reservation irregularity
In the event of a no-show (failure to show up by the Customer on the dates and days agreed in the Booking), PIC may charge a cancellation fee of up to the full price of the Services booked. These fees may be deducted from the amounts paid in advance if applicable or from the amount retained as security. Any reservation or payment that would be considered irregular, inoperative, incomplete or fraudulent by PIC for a reason attributable to the Customer will result in the cancellation of the reservation, without prejudice to any civil or criminal action against the latter, on the one hand, as well as the invoicing of cancellation fees in accordance with the Cancellation Policy or Special Conditions, on the other hand. As far as possible, PIC may put the Service concerned back on sale.
ARTICLE 4 — CONDITIONS OF STAY
4.1. Customer sheet
In accordance with article R. 611-42 of the Code of Entry and Residence of Foreigners and the Right of Asylum, the Customer authorizes PIC to pre-fill the individual police form called “Customer Form” with the information obtained during the reservation. The Customer will check the accuracy of the pre-filled information and will sign the said form upon arrival (check-in).
4.2. Pets
The Customer's pets are authorized and welcomed under certain conditions and, subject to prior written acceptance by PIC. Pets must be kept on a leash in the common areas of Maison Pic and remain under the supervision and responsibility of the Customer, under all circumstances. The Customer will be directly liable in the event of damage or inconvenience caused by the animal affecting PIC, third parties, employees or other Pic Customers. The cost of any damage caused during the stay may be invoiced to the Customer.
4.3. Pool
The pool area is reserved only for Maison Pic Customers. The presence of a parent or a responsible adult is mandatory to supervise children's swimming.
4.4. Kids
Children remain under the supervision and responsibility of their parents or a responsible adult. The Customer also undertakes to ensure that the children under his responsibility respect the calm of the establishment in all circumstances.
4.5. Valet parking and parking
PIC can offer valet parking services or allow the Customer to park their vehicle in the Maison Pic car park. By entrusting his vehicle, the Customer:
• authorizes PIC staff to drive the vehicle and move it, if necessary,
• declares that it has up-to-date insurance and technical control, under the conditions required by law;
• confirms having emptied the vehicle of all personal and/or valuable effects and goods not necessary for parking the vehicle and deactivated and/or removed the electronic toll and/or parking badge.
4.6. Laundry service
Depending on the case, PIC may offer its Customers a laundry service for its clothes. A discount slip is made available to Customers in their room and specifies the price of the services, the conditions for the execution of the services, the quality of the services offered as well as the conditions of compensation for the Customer in the event of loss or deterioration of the items as a fixed and final compensation. Laundry services are provided either by PIC or by an external service provider to whom the laundry is entrusted. It is recalled that PIC may, at its discretion, refuse an item or express any reservations about the cleaning of said item. PIC declines all responsibility in the event of color alterations or shrinkage.
4.7. Wifi and network access
The use of WiFi is free for Customers. The Customer is required to comply with PIC's security policy, including the rules for the use of security means implemented in order to prevent the illicit use of computer resources and to refrain from any act that undermines the effectiveness of these means. It is recalled that illegal downloading is strictly prohibited and is the responsibility of the Customer.
4.8. Rules of good conduct
The Customer undertakes, in all circumstances, to use the premises in a reasonable person and with respect for the people, property and image of PIC. In addition, the Customer undertakes not to harm the peace of mind of other Customers. Also, any behavior of the Customer and/or its guests that would be contrary to good morals, public order, the image and reputation of PIC, or likely to harm the safety of persons and property, will be likely to result in their expulsion from the establishment without delay. The Customer will then be required to pay PIC the full price fixed, without claiming any refund or compensation of any kind whatsoever. In the event that no payment has yet been made, the Customer must pay the price of the services consumed before leaving the establishment. PIC reserves the right to contact the police if necessary.
4.9. Damage and damage
During the stay, the Customer is responsible for the room made available to him, as well as for its furniture, and undertakes to make it clean in accordance with the condition in which they were at the time of arrival.
In general, the Customer assumes responsibility for the consequences resulting from his negligence, faults, errors, and more generally for any damage, direct and indirect, material or immaterial, caused to third parties or to PIC during his stay.
In the event of damage or deterioration not declared before the Customer's departure (check out), PIC reserves the right to deduct the amount necessary for the rehabilitation work as well as any ancillary costs related to the immobilization of the room during this period, if applicable.
4.10. security
A video surveillance system is set up by PIC within the establishment, especially at the reception and common areas in order to ensure the safety of goods and people. Safes are available to Customers in the rooms. However, it is recommended that Customers be careful with their personal items, and not to leave valuables in plain sight, especially in rooms, common areas or in vehicles parked in the PIC car park.
PIC declines all responsibility in the event of theft, loss, deterioration of the Customer's valuables, which are not deposited in the safes made available to the Customer.
The Customer undertakes to inform PIC before departure (check out), in the event that, during his stay, he is the victim of an accident or if one of his valuables should be damaged, lost or stolen.
4.11. No smoking policy
Customers are reminded that Maison Pic is a non-smoking establishment and that smoking is not allowed within the establishment.
The Customer is informed that smoking is exceptionally allowed on the terrace of the André Bistro, in the gardens.
ARTICLE 5 — DESCRIPTION OF SERVICES
The Site allows the Customer to book one or more Service (s) within Maison Pic.
The essential characteristics of the Services are described on the Site as well as on the dedicated documentation.
The Customer has the option of contacting the Maison Pic reception for any details or additional information.
The terms and conditions for booking and cancelling the Services are brought directly to the attention of the Customer according to the nature of the product or service ordered, when booking by the Concierge and by any means by the partner concerned. It is specified that cancellation fees may be requested from the Customer, under certain conditions, except in cases of force majeure.
5.1. Massages
The massage services offered to the Customer have no therapeutic or medical purpose, and consist of relaxation and well-being treatments. These treatments are carried out in the room by independent professionals selected by Maison Pic. It is specified that massages are not performed on pregnant women, minors or anyone with contraindications or allergies. Before any treatment, it is recommended that the Client discuss with the practitioner in order to assess, adapt or modify the type of treatment chosen.
The reservation and payment of the service are made at Maison Pic.
5.2. Pic experiences
Pic experiences are invitations to travel and discover the local region that can be personalized according to your desires. These are proposals that may vary depending in particular on the season, availability on the day of booking or the number of participants. In case of unavailability, an exit proposal may be replaced by another one that is at least equivalent. Prices and reservation conditions will be communicated to Customers when information is obtained from Maison Pic. It is specified that certain activities may be subject to reservations, allergies or contraindications by our partners.
Before any activity, it is recommended that the Customer discuss with the partner in order to assess, adapt or modify the type of activity chosen.
Any order of products or services by the Customer is subject to a reservation with Maison Pic, which may take the form of an estimate submitted to the Customer's prior approval. The validation of this order for products or services is carried out between the Customer and the partner concerned. Ordering products or services may be subject to direct payment to the Conciergerie based on the bill, unless otherwise agreed or provided.
ARTICLE 6 — FINANCIAL CONDITIONS
6.1. Service Prices
For Accommodation Services, the price relating to the reservation is per room, for the number of people, the dates and the Accommodation Services and, where applicable, the Ancillary Services selected by the Customer.
For Catering Services, the financial conditions are communicated by the restaurant concerned when booking. Depending on the applicable Cancellation Policy, certain fees may be charged to the Customer in the event of cancellation of the reservation or the Customer's no-show.
The price of the Services is indicated on the Site in euros and includes all taxes included, with the exception of any taxes included in the Special Conditions of the Reserved Rate and recalled in the Confirmation Email, (in particular the tourist tax - or equivalent - services charges...) and which must be paid directly on site by the Customer.
PIC may change the prices indicated on the Site at any time and without notice. However, the amended prices will only be applied to bookings made after the entry into force of the new prices.
6.2. Payment terms
6.2.1 Payment for Services
Payment for reservations for Services is made by any means directly to the establishment, by bank card exclusively (Visa, MasterCard or American Express) for any reservation made on the Site.
Credit cards and bank cards accepted are: Visa®, MasterCard®, American Express® and Carte Bleue®.
PIC may accept different payment methods but the Customer must then present at the reception of Maison Pic the bank card that allowed him to guarantee the reservation or to make the prepayment. PIC may also ask the Customer to present an identity document for the purpose of preventing bank card fraud.
Payment for the Services may be made by cash payment (exclusively in the case of payment on site, and within the limits of the payment limits set by French legislation).
(i) Guarantee of reservation of the Services
If the Customer does not pay for the Services when booking on the Site, he then transmits his banking information as a guarantee, via the secure link provided by PIC to the email address indicated by the Customer. In this case, the Customer's bank card is not debited when booking on the Site and the Customer pays for his reservation once on site directly at the Maison Pic reception. In addition, in the case of a reservation for a stay made on the same day of the Customer's arrival, it will be requested to proceed with the immediate payment of the reservation upon Check-in.
(ii) Prepayment of Services
According to the Special Conditions and the Cancellation Policy, payment is made:
• In full at the time of booking;
• Or in part at the time of booking, in the form of a deposit. The Customer will be invited to pay the balance of his reservation before the cancellation deadline indicated in the Special Conditions and/or the Cancellation Policy recalled in the Confirmation Email. For the payment of the balance of the reservation, payments can be made by bank card, via the secure link provided by PIC to the email address indicated by the Customer, or by bank transfer and in Euros only. PIC cannot be held responsible for any additional fees requested by banking institutions in this respect. In case of payment by bank transfer, the Customer must ensure that his name and dates of stay are specified on the transfer order and send to PIC a copy of the payment confirmation issued by the Customer's bank. PIC reserves the right to cancel the reservation without notice, if the required deposit amounts and/or payment of the balance of the reservation are not paid on time.
In the event that, regardless of the cause (opposition, refusal by the issuing center, etc.), the debit of the amounts due by the Customer proves impossible, the reservation will be immediately cancelled. The Customer will be informed by email to the address provided by the Customer when booking.
In all cases, upon departure of the customer (check-out), the other Services and Ancillary Services consumed by the Customer during the stay are also invoiced to him.
6.2.2 Check-out or post-check-out debit
Insofar as certain amounts would not have been paid in full on the day of departure, PIC has the right to invoice and debit these amounts within ten (10) days from the check out, using the imprint made at the time of reservation or that made at the check in, for example (these examples being non-limitative), for services consumed without payment, transfers, consumption of the minibar in the room, damage, breakages, thefts, non-payment, the sending of a forgotten object, the customer's laundry services, the loss of the keys of bedroom or safe, etc.
ARTICLE 7 — PERSONAL DATA
As part of the execution of the Services or the processing of an order, the Groupe PIC and/or PIC are required to process the personal data of Customers and users of the Site, under the conditions provided for in the Privacy Policy available. In accordance with Article L. 223-1 of the Consumer Code, the Customer has the possibility of registering free of charge on a list of opposition to Bloctel telephone canvassing (www.bloctel.gouv.fr) in order to no longer be contacted by telephone by a professional, except when it comes to solicitations occurring in the context of the execution of an ongoing contract and relating to the object of this contract.
ARTICLE 8 — FORCE MAJEURE
The Parties agree to apply article 1218 of the Civil Code and the case law of the French courts. It is specified, for all practical purposes, that events of personal convenience are not considered to be events of force majeure.
ARTICLE 9 — MODIFICATION OF THE TERMS AND CONDITIONS - TRANSLATION
The GTC may be modified and/or supplemented at any time by PIC. In this case, the new version of the Terms and Conditions will be placed on the Site in a readable and accessible format in order to allow the Customer to access and easily read them.
The terms and conditions amended or completed in this way will take effect as soon as they are posted on the Site and will automatically apply only to purchases and/or reservations made after they are posted online. Purchases and/or reservations prior to the online date will be governed by the previous version of the Terms and Conditions.
For convenience, a translation of the GTC into English has been prepared. However, it is expressly agreed that only the French language version prevails over any other translation.
ARTICLE 10 - APPLICABLE LAW AND DISPUTE RESOLUTION
The General Terms and Conditions, and the Cancellation Policy are governed and interpreted in accordance with French law, in accordance with EC Regulation 593/2008 of 17 June 2008, without impeding any mandatory protective provisions that may apply in the consumers' country of residence.
In the event that one of the provisions of the Contract should be declared void, unenforceable or unenforceable by any competent jurisdiction, the other provisions will remain valid, applicable and enforceable unless otherwise provided by such jurisdiction.
Any complaint, dispute or claim related to the application and/or interpretation of the Contract or Services must be sent by the Customer, by email or in writing accompanied by all the relevant elements, so that a response can be provided quickly.

In the event of a dispute between the Parties, they will endeavour to find an amicable solution. In the absence of an amicable agreement, the Customer is informed that he has the possibility of using a conventional mediation procedure or any other alternative dispute resolution procedure. In accordance with ordinance no. 2015-1033 of 20 August 2015 and with implementing decree no. 2015-1382 of 30 October 2015, the Customer has the possibility, for any dispute or so-called consumer dispute, subject to article L612-2 of the Consumer Code, to contact the consumer mediator responsible for PIC, free of charge, to contact the consumer mediator responsible for PIC, namely the Association of European Mediators (AME CONSO), within one (1) year from written complaint addressed to Pic.
The referral to the consumer mediator must be made:
• or by completing the form provided for this purpose on the AME CONSO website: www.mediationconso-de.com on the “ONLINE REFERRAL FORM” tab;
• or by post addressed to AME CONSO, 197 Boulevard Saint-Germain - 75007 Paris.
AME CONSO will attempt, in complete independence and impartiality, to reach an amicable resolution of the dispute.
The Customer remains free to use mediation or not. In the event of recourse to mediation by PIC, the Customer is also free to accept or refuse the use of mediation. Once the mediator's decision has been rendered, each party is free to accept or refuse the solution proposed by the mediator.
Any difficulties relating to the interpretation, execution and expiration of the Contract, general conditions of sale or services will be subject, in the absence of an amicable agreement under the above conditions, to the exclusive jurisdiction of the competent courts of Lyon, and this even in the event of summary proceedings, warranty claims or multiple defendants. As an exception to the above, in accordance with the provisions of Regulation No. 44/2001 of 22 December 2000:
• the Customer may choose to bring any dispute either before one of the territorially competent courts under the Code of Civil Procedure, or the jurisdiction of the place where he lived at the time of the conclusion of the contract, or of the occurrence of the harmful event, in accordance with Article R. 631-3 of the Consumer Code;
• PIC may refer the matter to the court in the place where the Customer is domiciled.
